“i am indeed lord of the world, but the law is lord of the sea. this matter must be decided by the maritime law of the rhodians, provided that no law of ours is opposed to it.” the lex rhodia were largely concerned with merchant shipping and commercial practice, and were surprisingly democratic, sometimes requiring consultation with the crew: if a ship is in haven and stays to await her time, and the time comes for departure, the master is to take counsel with his companions and say to them— “sirs, you have this weather.” there will be some who will say “the weather is not good” and some who will say the weather is “fine and good.” the master is bound to agree with the better part of his companions, and if he does otherwise he is bound to replace the ship and the goods if they are lost. rhodian law was codified by byzantine emperor justinian in the 6th century, with regulations that divided liability for loss of cargo due to piracy, or by jettison during storms, between the shipowner, the owner of the cargo, and the passengers. rhodian law influenced development of the 12th century roles of oleron, and persisted in the maritime laws of italian medieval cities until at least the 14th century. see also laws and conventions of the sea, maritime law and united nations convention on the law of the sea.
