- That branch of international law, or the law of nations, which consists of general principles, chiefly derived from ancient codes of law, and admitted by civilized nations, as to commercial intercourse with enemies and neutrals.
- Is a complete legal system, with three major components or sources—common legal principles (evolved over millennia of civil usage), national statutes, and international conventions. collectively, these cover the laws of: • contract (charter parties) • sale (of ships) • service (towage) • lease (chartering) • carriage (affreightment) • agency (chandlery) • pledge (bottomry and respondentia) • hire and employment (masters and crews) • risk distribution (general average) • compensation (injury or illness) • indemnity (marine insurance) also known as admiralty law, it includes such concepts as constructive presence, force majeure, hot pursuit, innocent passage, and right of visit, as well as defining contiguous zones, exclusive economic zones, territorial seas, and the like. - A feature of admiralty law that holds a vessel liable for the non-payment of obligations. this makes it very different from a land lien, since it does not reflect personal liability of the shipowner, or its captain or operator, but holds the vessel itself to be a legal entity with obligations that can be breached. once issued, a maritime lien can only be foreclosed (“executed” in maritime parlance) by an admiralty court and cannot be modified by agreement between the parties. it follows the vessel wherever it goes and can be enforced by any country which obtains jurisdiction. claims must be maritime by nature and only certain types apply, the most important (in descending order of precedence) being: • seamen’s unpaid wages • salvage fees • tort, including collision and personal injury • general average claims • preferred ship mortgages • necessaries, supplies, and repairs • towage, lighterage, wharfage, stevedoring, pilotage, and the like marine 192 • cargo damage due to improper loading, storage, or custody • unpaid freight • breach of charter party • marine pollution.
