General average, английский
- Average means loss, hence general average means general loss in a maritime sense. if an event occurs which endangers the whole voyage, then all loss which arises in consequence of extraordinary sacrifices made or incurred for the preservation of the ship and cargo come within the ambit of general average, and the master or owners may declare general average. such events may include stranding, fire, loss of propellor, etc. specialized ga adjusters then assess the potential damages and proportion costs against all parties to the voyage, including the ship owners, cargo owners, etc. all normal marine insurance policies include cover against ga. the yorke-antwerp rules are an agreed international protocol for dealing with this event.
- A claim made upon the owners of a ship and her cargo, when the property of one or more has been sacrificed for the good of the whole.
- An ancient principle of maritime equity which holds that when a peril threatening a ship’s survival has been averted by jettisoning cargo, supplies, or furniture, the voluntary sacrifice has been for the good of all and must be shared pro rata by all parties concerned (shipowners, cargo owners, and owners of freight revenue). the principle was established at least as early as the laws of rhodes (ca. 916 bce).
- Provision in maritime law where all shippers on a given voyage would reimburse the ship line in the event of vessel sinking or catastrophic damage. it also provides for the reimbursement to those shippers whose cargo was thrown overboard in order to save the vessel.
